Unfair Distribution Without A Will
We met with a prospective client, Mr. A recently. While Mr. A did not know much about Wills, he has experienced first hand when people grab assets upon the death of relatives. Mr. A’s father died without a Will. He was not wealthy and only have a property worth less than RM 100,000. The elder brother applied to be the administrator therefore Mr. A and 3 other siblings have to give up their rights.
Upon getting the Letters of Administration (LA), the elder brother claimed that since the other siblings are better off, they don’t need the father’s property and took the property all for himself. To avoid disputes and bad blood within the family, Mr. A and other siblings kept quiet but ill feelings was created. Even if they wanted to, they could not dispute since they have given up their rights earlier.
In another incident, Mr. A’s grandmother passed away. At the hospital, before the body was cold, all her jewelry was stripped by those by her bedside. Even though in the past, she mentioned to all the children, she want her daughters to have a piece each.
While even with a Will, it would be difficult to prevent greedy relatives from stripping jewelry off the body, a Will would have prevented the first incident. So don’t allow such things to happen and write a proper Will as soon as possible.
